In a major setback to Lok Insaaf Party President and Ludhiana MLA Simarjit Singh Bains, the Punjab-Haryana High Court has upheld the decision of the trial court of Ludhiana, which ordered registration of an FIR against Bains. While filing the petition, Bains had said that the victim had filed a petition against her and her accomplices, which was allowed by the court and directed the FIR against them and ordered them to submit the status report.
The petitioner had told that the woman has been accusing him of rape for the past several months. The allegation is that she had met the petitioner due to a property dispute. The petitioner had raped her in a room built in his office. After this, the woman gave a written complaint against it to the police commissioner and other officials on 16 November 2020 and demanded registration of an FIR.
Despite complaints at every level, the woman had alleged that no action was taken. The trial court, after hearing both the sides, allowed the petition of the victim and issued an order to the Ludhiana police to register a case against the petitioner and his accomplices. The petitioner had appealed to the High Court denying the allegations outright. The High Court on Friday dismissed Bains’s plea, saying that the complaint against him was a cognizable offense and as such it was imperative to investigate it. There is no flaw in the order of the FIR issued by the Additional CJM on 7th July. Therefore, the order of registration of FIR cannot be quashed.
